DURATION OF RENTALNo rental can be longer than 20 days
PAYMENT
a.
A late fee of $50.00 per day will be charged to the Borrower for late returns.
b.
In the event that borrowed equipment is found upon return to be damaged beyond the scope of any warranty or insurance coverage, or are returned incomplete and/or damaged, the Borrower agrees to pay to the BVIU the cost to repair or replace the item.
RENTAL TERMS AND CONDITIONS
a.
The Borrower may take possession of the borrowed equipment for a period of 20 calendar days (“borrowing period”) from the date on which it is received from BVIU. Renewal periods may be available to the Borrower at the discretion of BVIU. For equipment that is in high demand or in need of repair and/or maintenance, the BVIU reserves the right to delay or defer renewal periods where the Borrower has already borrowed the equipment for at least one borrowing period.
b.
The Borrower is responsible to provide sufficient means of transporting the equipment in a safe manner, sufficient to avoid damaging the equipment, and to make arrangements to pick up and return the borrowed equipment from and to the BVIU without damage to the equipment.
c.
The Borrower must provide a responsible person to inspect and sign out for the equipment upon pick up and return of equipment.
d.
The borrowed items shall be returned in the packaging in which the Borrower received the equipment, and in the same condition as when it was borrowed, with the exception of normal wear and tear.
e.
The Borrower is responsible to maintain general liability and/or property damage insurance coverage that will cover the equipment against any damage incurred while it is in the possession of the Borrower. The Borrower shall be responsible for and shall compensate the BVIU for any losses or damage to the equipment while in the possession of the Borrower that are in excess of normal wear and tear.
f.
Upon return of the equipment, the BVIU will review and inspect the equipment and will notify the Borrower in writing of any damage assessed. Borrower agrees to be responsible to reimburse BVIU for all such damage incurred while the asset was in control of Borrower.
g.
The Borrower may not remove the equipment from the location shown above as the place of use of the equipment without prior written approval of the BVIU. The Borrower shall inform the BVIU upon demand of the exact location of the equipment while it is in the Borrower's possession.
h.
The BVIU makes no warranty of any kind regarding the rented equipment, except that BVIU shall endeavor to replace the equipment with identical or similar equipment if the equipment fails to operate in accordance with the manufacturer’s specifications and operation instructions. Such replacement shall be made as soon as practicable after Borrower returns the non-conforming equipment.
i.
The BVIU reserves the right to revoke borrowing privileges in the event borrowed equipment is not given proper care while in possession of the Borrower.
j.
The Borrower agrees to be responsible to pay to the BVIU the full cost of replacement and/or repair of any equipment which is not returned because it is lost or stolen or any equipment which is returned in a damaged condition.
k.
Borrower agrees to be be responsible to pick up the borrowed asset on the date designated and to return the asset as agreed. Prior to borrowing the equipment, the Borrower will be required to attend an equipment training.
l.
The Borrower shall pay the BVIU upfront for any fees associated with the use of an asset. Failure to make the required payment will invalidate the rental.
m.The Borrower agrees to not permit any person to use or operate the borrowed asset unless that person has attended the proper training workshop and has exhibited the ability to operate the equipment in a safe and proper manner. Borrower agrees to be fully responsible for all damage to the equipment or to person or property caused by operation by an untrained or incompetent operator.
SAFETY
1.
Borrower agrees to indemnify and hold BVIU harmless from any and all liability for damage to the borrowed equipment and for any claims for personal injury or property damage incurred by any person or entity arising in any way out of the possession, operation, control, use or misuse of the borrowed property while in the possession of Borrower.
